OPINION

DYESS, Justice.

Appellant was convicted by a jury of driving while intoxicated. See TEX.REV.CIV. STAT.ANN. art. 6701l-1 (Vernon Supp.1990). The court assessed punishment at 180 days confinement, probated for two years, and a $400.00 fine.

We affirm, and in so doing, make the following observations.
