Thorne was convicted of distribution of preludin in connection with an incident which occurred on June 4, 1983 (Count 1). He was acquitted of distribution of heroin in relation to an incident which occurred on November 6, 1983 (Count 3). He appeals from his conviction on Count 1, contending that that count should have been severed from Count 3 and that the government engaged in prosecutorial misconduct by purposely securing an invalid indictment...
