Kurt C. Bendixsen and Garry L. Reynolds, P.C., Hermiston, for appellant.

Dave Frohnmayer, Atty. Gen., Virginia L. Linder, Sol. Gen., and Wendy J. Paris, Asst. Atty. Gen., Salem, for respondent.

Before BUTTLER, P.J., and WARREN and ROSSMAN, JJ.
