Justice MILLER delivered the opinion of the court:

Following a bench trial in the circuit court of Cook County, the defendant, Jimmie Tye, was convicted of the murder of his three-year-old daughter, Jasmin James. The State requested a hearing to determine whether the defendant should be sentenced to death for the offense. The defendant waived a jury for purposes of the sentencing hearing. The trial judge determined that the defendant was eligible for the death penalty...
