The defendant, Larry D. Miller, was found guilty as charged after a jury trial on two counts of distribution of marijuana and one count of distribution of cocaine, in violation LSA-R.S. 40.966 & 967. He was sentenced to imprisonment at hard labor for five years on each count. The trial court ordered that the sentences for the marijuana charges be served concurrently with each other.
