Defendant, Wallace Posey, along with his brother-in-law, Ricky Frith, were jointly charged by bill of information with simple burglary, in violation of LSA-R.S. 14:62. Frith pled guilty and was sentenced to three years at hard labor. Posey was tried by jury and found guilty as charged.
