Movant Larry Ward appeals from an order denying, after an evidentiary hearing, his amended Rule 27.261 motion to set aside a judgment and sentence to life imprisonment for first degree murder. Initially, movant was charged with capital murder, but on September 23, 1983, pursuant to a plea bargain, the amended information charging first degree murder was filed and movant entered a guilty plea to the amended information.
