Timothy Grier was charged with driving while intoxicated (DWI) in violation of AS 28.35.030(a), and with minor consuming alcoholic beverages in violation of AS 04.16.050. District Court Judge Christopher E. Zimmerman granted Grier's motion to suppress the results of a breathalyzer test, blood test, and videotape on the grounds that the arresting officers lacked probable cause to arrest Grier for driving while intoxicated.
