These actions arise out of a tragic airplane accident which occurred in Cove Neck, New York, on January 25, 1990.1 As a result of this unfortunate event, the Court is presented with its first opportunity to consider whether the Warsaw Convention, 49 Stat. 3000, reprinted at 49 U.S. C.App. 1502 (1976)2 provides the exclusive cause of action for the victims...
