Appellant Valdez appeals from his conviction under 8 U.S.C. § 1326 for Re-Entry of Deported Alien. Valdez contends that the two deportation hearings used as the basis for his criminal conviction under § 1326 violated his due process. Specifically Valdez claims that the immigration law judges in both deportation hearings did not warn him of his right to remain silent during the proceedings.
