This suit arises from a work-related accident wherein the plaintiff, William Lynn Anderson, was struck by a forklift driven by an employee of the defendant, Bennett Wood Fabricators (hereinafter referred to as "Bennett"). A jury assessed comparative fault of 70% to Bennett and 30% to the plaintiff. The jury awarded special damages of $180,000 and general damages of $100,000.
