BIRCH, Judge.

The Circuit Court of Maury County entered judgment upon a jury verdict convicting Charles R. Mencer, the defendant, of conspiracy to possess a Schedule VI controlled substance (marijuana) with intent to sell or deliver.1 For this offense the trial court imposed a five-year sentence to be served in the Department of Correction.
