Presently before this Court are defendants' motions for summary judgment. This case concerns the legality of the purchased-coal clause contained in the 1981 National Bituminous Coal Wage Agreement (NBCWA). This clause obligated NBCWA signatories to contribute a certain sum to the United Mine Workers of America (UMWA) Health and Retirement Funds for each ton of coal purchased by a signatory from a non-signatory.
