Before us for consideration is the appeal of Local 325 of the United Food and Commercial Workers Union (Local 325) from an order of the Court of Common Pleas of Allegheny County which sustained preliminary objections to Local 325's petition for the appointment of viewers filed by the Department of Transportation (Department) and dismissed Local 325's general damage claim.
