Walter Axline was convicted and sentenced for vehicular homicide, Iowa Code § 707.6A (1987), and operating while intoxicated (OWI), Iowa Code § 321J.2. He appealed on the grounds that (1) the court erred in refusing to suppress his blood test results, (2) he was denied effective assistance of counsel, and (3) the court erred in sentencing him on both the vehicular homicide and OWI convictions.
