VANDE WALLE, Justice.

Fort Yates Public School District No. 4 (Fort Yates) appealed from judgment on a jury verdict finding it liable to Linda Binstock for personal injuries received in an altercation with Larry Huckins at the Fort Yates Public School. Binstock has made a motion to dismiss the appeal. We deny the motion to dismiss the appeal, reverse the judgment and remand the case for a new trial on liability only.
