Appellee Viola Markins was awarded a judgment in Boone Circuit Court for injuries she sustained in a fall on the premises of appellant Get-N-Go. Get-N-Go appealed the judgment on several grounds and the Court of Appeals reversed the trial court, holding that Markins had incurred the risk of her injuries as a matter of law.
