Per Curiam.

Plaintiff leased an apartment in a building owned by defendant John Tuley (hereinafter defendant) under the terms of an oral month-to-month tenancy. In July 1988, plaintiff either abandoned the property, as asserted by defendant, or was physically dispossessed, as plaintiff claims.
