Appellant Carl Kruzich appeals from the judgment and sentence of the district court placing him on probation for two years. He pled guilty to the crime of delivery of a controlled substance in violation of W.S. 35-7-1031 (June 1988 Repl.) and at sentencing, asked that he be treated as a first offender under W.S. 7-13-301 (June 1987 Repl.).
