Jerome F. Frake was convicted and sentenced for operating while intoxicated (OWI), second offense, in violation of Iowa Code section 321J.2 (1987). The court of appeals, on a divided vote, reversed on the ground that the trial court's findings of fact and ruling on a motion to suppress were not supported by substantial evidence.
