DOOLEY, Justice.

This proceeding involves district court review of the grounds and procedure for dismissing a police officer. We hold that the statute that authorizes this proceeding violates the separation of powers provision of the Vermont Constitution, Chapter II, § 5, and dismiss the proceeding.
