This Cause is before the Court upon the defendant's motion for summary judgment filed pursuant to Rule 56 of the Federal Rules of Civil Procedure. As a result of a lease dispute, Bayshore Executive Plaza ("EXECUTIVE PLAZA"), the lessor, instituted this action against the lessee's liquidator, the Federal Deposit Insurance Corporation ("FDIC").
