This appeal concerns a claim by a materialman pursuant to the Private Works Act, La.R.S. 9:4801 et seq. The parties stipulated to the following facts.

On or about October 10, 1982, Stephen Lynn Dickey and Sherilyn Stevens Dickey entered into a purchase Agreement with Kelley Gauley wherein they agreed to purchase Lot 10(A) of the re-subdivision of the Spring Ranch Subdivision together with a new house that was to be constructed...
