OPINION

FAY, Chief Justice.

This case comes before this court on appeal by the defendant from a Superior Court judgment in favor of the plaintiff and on cross-appeal by the plaintiff regarding the trial justice's restriction of the jury's award to him. We affirm the trial justice's decision and deny the defendant's appeal. The plaintiff's cross-appeal is denied and dismissed.
