This appeal arises from a decision on the habeas corpus petition of Steven Satter (Satter) challenging the constitutionality of his conviction on two counts of murder. This court affirmed that conviction on direct appeal. State v. Satter, 90 S.D. 485, 242 N.W.2d 149 (1976) (Satter I). The decision reversing the habeas court was filed April 20, 1988,
