This cause involves two appeals consolidated for review by this Court. Each arises from a wrongful death suit filed in the Circuit Court of the First Judicial District of Hinds County, Mississippi, the Honorable Fred L. Banks, Jr., presiding. At the trial level, summary judgment was entered in favor of the plaintiff and against the decedent's uninsured motorist carrier, Shelter Insurance Company, in the sum of $50,000.00. The case...
