Movant Bruce Kilgore was convicted by a jury of first-degree robbery, § 569.020,1 kidnapping, § 565.110, and first-degree murder, § 565.020. The jury assessed the death penalty on the murder charge. On October 23, 1987, Kilgore was sentenced by the court as a prior offender, § 558.016, to consecutive life sentences on the robbery and kidnapping charges, and to death on the murder charge.
