OPINION

CAMPBELL, Judge.

This is a post-conviction application for a writ of habeas corpus transmitted to this Court pursuant to Art. 11.07, V.A.C.C.P. from the trial court. Applicant was convicted by a jury of attempting to acquire a controlled substance by fraud. After finding that applicant had previously been convicted of a felony, the jury assessed his punishment at 98 years and one day in the Texas Department of Corrections.1
