This is an action brought by the plaintiff pursuant to the Federal Tort Claims Act (FTCA), 28 U.S.C. §§ 1346(b), 2671 et seq. Plaintiff contends that he suffered damages when the United States negligently destroyed his military medical records. The damages sought by plaintiff are the amount of disability benefits he would have received had he been able to prove certain service-connected illnesses...
