Petitioner was convicted of second degree murder in 1964 and sentenced to a term of 20 years' to life imprisonment. He was released on parole in 1975. In 1977, petitioner was convicted of second degree kidnapping and second degree criminal possession of a weapon for which he was sentenced to concurrent prison terms of 12½ to 25 years and 7½ to 15 years, respectively.
