This matter comes on to be heard upon the motion of the Debtor, Robert E. Hutton ("Hutton"), to dismiss the complaint of Pacific-Midwest Gas Company, debtor-in-possession, plaintiff ("Pacific-Midwest"), asking that the claim of Pacific-Midwest against Hutton be declared nondischargeable under § 523(a)(4) of the Bankruptcy Code.
