Supreme Court properly granted defendant's motion to stay the action for a declaratory judgment and compel arbitration. The 1969 agreement to supply water to defendant is valid on its face because it allows the plaintiff to recover the costs of water production by increasing the water rate across the board. The City Charter does not prohibit plaintiff from exercising its discretion in setting the water...
