After a jury trial, Defendant-Appellant Allan Von Tripp was found guilty under Hawaii Revised Statues (HRS) § 709-906 (1986 & Supp. 1989), Abuse of Family and Household Members. HRS § 709-906 reads in relevant part:

(1) It shall be unlawful for any person, singly or in concert, to physically abuse a family or household member, ... For the purposes of this section, "family or household member" means spouses or former...
