THOMAS, Chief Justice.

In September 1986 January Mulaula and his wife, as next friends for their minor son, Stephen, filed a medical malpractice suit in a Dallas district court. They did so after entering into a fifty-percent contingent-fee contract with the attorney who filed the suit. In November 1987, while the malpractice suit was still pending in the district court, the Mulaulas opened a guardianship...
