This is an appeal from a judgment of the Court of Appeals reversing the trial court's decree that defendant's dog be destroyed. See T.C.A. § 44-17-120. The Court of Appeals held that there was no material evidence to support the trial judge's order, and that the entry of judgment without evidence was a denial of due process.
