On June 6, 1986, at about 5:45 P.M., defendant Franklin D. Mackes was operating a 1984 Kenworth tractor trailer at approximately 50 to 55 miles per hour in the Town of Canaan, Columbia County, proceeding south on State Route 22, a two-lane blacktop highway, 23½ feet wide with a six-foot west shoulder and an eight-foot east shoulder.
