John K. Spees pleaded guilty to one count of possession with intent to distribute methamphetamine in violation of 21 U.S.C. § 841(a)(1) and (b)(1)(B) (1988), and was sentenced by the district court1 to the statutory minimum sentence of sixty months of imprisonment. Spees appeals from the sentence imposed, arguing that his fifth amendment due process rights were violated when the court declined, despite Spees' assistance...
