OPINION

NYE, Chief Judge.

Appellant, Marco Antonio Quintero, pleaded nolo contendere in a bench trial for the offense of attempted capital murder for which the court found him guilty. At the punishment phase of the trial, a jury affirmatively found that appellant used or exhibited a deadly weapon in the commission of this offense and assessed punishment at sixty-five years' confinement in the Texas Department of Criminal Justice, Institutional Division....
