This appeal in a criminal case was last before this same court panel on rehearing in 1989. In an opinion filed July 24, 1989, United States v. Hughes, 880 F.2d 101 (8th Cir.1989), we remanded for consideration of the government's explanation for using its peremptory challenges to exclude three black members of the trial jury venire. See Batson v. Kentucky, 476 U.S. 79
