Plaintiff sued his employer, El Paso Natural Gas Co. (employer), in common law tort for personal and related injuries and damages resulting from an accidental injury in the course and scope of plaintiff's employment. Employer filed a motion to dismiss for failure to state a claim upon which relief can be granted, pursuant to SCRA 1986, 1-012(B)(6).
