This matter is before the Court on defendant's motion for summary judgment. Defendant, J.C. Penney Company, Inc. ("Penney"), brings it motion pursuant to Federal Rule of Civil Procedure 56(b). The instant action was filed in Berrien County in December of 1988, and properly removed to this Court by the defendant in January of 1989 on the basis of diversity jurisdiction.
