OPINION

MURPHY, Justice.

Harold Willis appeals his conviction for possession of a controlled substance with intent to deliver. Following a trial to the bench, punishment was assessed at twentyfive years confinement and a $10,000.00 fine. On July 26, 1990, this court issued an opinion reversing appellant's conviction and remanding the cause to the trial court. On July 30, 1990, the state filed its second motion for rehearing.
