PER CURIAM.

Defendant filed an application for leave to appeal from the circuit court's order denying his motion to quash and his motion to effect his right to compulsory process by conferring immunity upon a defense witness. This Court denied defendant's request. On appeal, our Supreme Court remanded this case to us to consider as on leave granted. People v Schmidt, 432 Mich. 911; 444 N.W.2d 114 (1989). We affirm.
