The petitioner, a citizen of El Salvador, applied for asylum and withholding of deportation on the basis of his fear of persecution by communist rebels should he be returned to El Salvador. The immigration judge denied relief, holding that the petitioner had not met his burden of proving that he had a well-founded fear of persecution or that such persecution was more likely than not.
