Troy Edward Daff was found not guilty of the assault and battery of two persons. The State filed an order of appeal, but before its right to do so could be challenged, it dismissed the appeal. The State then filed new charges against Daff for the same offenses. Daff procured the dismissal of those charges on double jeopardy grounds, and the State again appealed.
