Defendant challenges his convictions of marijuana possession with the intent to distribute and marijuana production. Both offenses are third degree felonies under Utah Code Ann. § 58-37-8(1)(a) (Supp. 1989). He was also convicted of failing to purchase drug tax stamps required by Utah Code Ann. § 59-19-103(1)(b) (Supp. 1989). Defendant does not dispute the facts as found by the trial judge.
