On January 12, 1983 the defendant, Frederick J. Bailey, Jr., ("defendant") was charged by bill of information with theft of $6,679.56 worth of building materials in violation of LSA-R.S. 14:67 to which he pled not guilty. The defendant waived his right to a jury at the outset of trial on December 12, 1983 and the matter proceeded before a trial judge who found him guilty as charged.
