A November 14, 1984 indictment charged defendant with four counts of criminal sale of a controlled substance in the third degree. A later indictment on December 19, 1984 charged defendant with one count of criminal sale of a controlled substance in the third degree and one count of criminal possession in the third degree. The indictments having been consolidated for trial, the People moved, on September 18, 1985, to sever counts Nos. 1 and 2...
