Thomas A. Monahan is one of a group of former employees who sued Paine Webber Group, Inc. ("Paine Webber") under the Racketeer Influenced and Corrupt Organizations Act ("RICO"), 18 U.S.C. §§ 1961-1968 (1982). In an earlier opinion, the RICO complaint was dismissed for failure to state a cause of action and, in the alternative, on the grounds that the claims were barred as res judicata. Cullen v.
