Defendant-appellant, Edward A. Finnegan, was, on an earlier occasion, convicted by the district court of third degree assault and sentenced to probation. Upon a subsequent finding that Finnegan had violated a term of his probation, the district court revoked probation and, instead, sentenced Finnegan to incarceration for a period of 6 months and ordered him to pay court costs.
